Terms and Conditions
Operated by Mittal Education, India
About us and these Terms
2ndRank is a brand operated by Mittal Education, a business registered in India ("2ndRank", "we", "us", "our").
We provide live, one-to-one online tutoring to school-age students, together with curriculum, homework, assessment and progress reporting delivered through our student platform.
These Terms form a legally binding agreement between you and us. They are an electronic record under the Information Technology Act, 2000 and do not require a physical or digital signature. By registering, enrolling a student, making a payment or attending a session, you confirm that you have read, understood and agreed to these Terms and to our Referral and Scholarship Policy where it applies to you.
If you do not agree to these Terms, you must not enrol or use the platform.
Definitions
- "Student" means the child or adult learner enrolled in a programme.
- "Parent", "you" or "your" means the parent or legal guardian who enrols a Student under 18, or an adult Student enrolling personally.
- "Mentor" or "Trainer" means the teacher we assign to deliver sessions.
- "Class Manager" means the member of our academic team assigned to your family as your single point of contact.
- "Session" means one scheduled one-to-one class of 55–60 minutes.
- "Programme" or "Course" means the package of Sessions, curriculum and materials you have purchased.
- "Platform" means our student portal, websites, applications and any system we use to deliver the Programme.
Eligibility and registration
Where the Student is under 18, only a parent or legal guardian may register and enrol. By enrolling, you confirm that you are the parent or legal guardian, that you consent to the Student's participation in Sessions, assessments and programme activities, and that you accept responsibility for the Student's conduct during Sessions.
An adult Student aged 18 or over may register personally and accepts these Terms on their own behalf.
You must provide information that is true, accurate, current and complete, and keep it updated. One registration is permitted per mobile number and per email address. You are responsible for keeping your login credentials confidential and for all activity on your account. Accounts are personal and may not be transferred, shared or sold.
Providing false identity or contact details is a suppression of material fact and may result in immediate termination without refund, in addition to any other remedy available to us in law.
Enrolment and start of classes
Enrolment is confirmed only once payment (or the first instalment, where an instalment plan applies) has been received and cleared. No regular Sessions will be scheduled or delivered before payment has cleared.
Following confirmation, the Student will be onboarded onto our Platform, assigned a Mentor and a Class Manager, and issued a recurring Session schedule based on Mentor availability and the time slots you have selected.
Trial or demonstration sessions offered before enrolment are provided at our discretion, do not form part of any purchased Programme, and create no obligation on either party to proceed.
How classes are delivered
Each Session runs for 55 to 60 minutes and is delivered one-to-one online.
Curriculum, learning content, homework and assessments are assigned through the Platform, and progress is visible to you there.
The Student is expected to attend on time, with a working device and internet connection, and to complete homework assigned between Sessions.
Curriculum and course content are subject to change to reflect the Student's progress and interests, curriculum updates, and improvements we make to our programmes. Any change will maintain or improve the overall standard of the Programme.
Student no-show
If the Student has not joined within 15 minutes of the scheduled start time, the Session is recorded as a student no-show. The Session is treated as delivered, is deducted from your Programme, and is not refundable, reschedulable or reimbursable.
Cancellations by us
If a Session is cancelled for a technical reason on our side, a Mentor no-show, a declared holiday, or any other circumstance attributable to us, the Session will be added back to your schedule at no cost and you will be informed in advance wherever it is possible to do so.
Attendance and student conduct
Sessions are one-to-one and depend on the Student's engagement. Where a Student is persistently inattentive, disruptive, or absent from the Session while nominally joined, the Mentor will raise this with the Class Manager. We will then:
- issue a written warning to you and the Student;
- monitor subsequent Sessions and share observations with you; and
- where the behaviour continues, suspend or terminate the Programme in accordance with Section 25.
Abusive, threatening, discriminatory or harassing behaviour towards a Mentor or any member of our team will result in immediate suspension and may result in termination without refund.
Communicating with your mentor
All communication runs through your Class Manager. Your Class Manager handles scheduling, Mentor changes, academic queries, progress questions and complaints.
Mentors are engaged to teach scheduled Sessions. Informal or direct communication with a Mentor outside the Session — including private messaging, calls, social media contact, or any arrangement for tuition outside the Platform — is not permitted. We are not responsible for, and accept no liability in respect of, any direct communication, arrangement or payment made between you and a Mentor outside the Platform.
Breach of this Section is a material breach and may lead to cancellation of the entire Programme in accordance with Section 25.
If you need academic help from the Mentor outside a Session, raise it with your Class Manager, who will arrange it.
Cancellation and rescheduling of individual sessions
| Situation | What happens |
|---|---|
| You cancel with at least 120 minutes' notice | Session is returned to your schedule and may be rescheduled |
| You cancel with less than 120 minutes' notice | Session is treated as delivered and deducted |
| Student does not join within 15 minutes | No-show. Session is deducted and not reimbursed |
| Mentor cancels or does not attend | Session is added back to your schedule at no cost |
| More than 2 cancellations by you in a calendar month | Additional cancelled Sessions are deducted and not reimbursed |
All cancellations and reschedule requests must be made to your Class Manager, not to the Mentor.
A cancelled Session must be rescheduled and taken within 7 days of the original scheduled date, subject to Mentor availability. A Session not rescheduled within that window lapses and is deducted.
You may cancel a maximum of two Sessions in any calendar month with the benefit of rescheduling. This limit does not apply to Sessions cancelled by us.
To change your regular weekly schedule permanently, give your Class Manager at least 15 days' notice. A permanent change depends on Mentor availability; where your current Mentor cannot accommodate the new timing, we may offer you an alternative Mentor, which you are free to accept or decline. The same notice period applies where you relocate to a different time zone.
Pausing your course
We understand that holidays, travel and illness happen. You may pause your Programme for holidays, vacation or medical reasons as follows:
- a maximum of 20 calendar days per pause;
- a maximum of two pauses in any 12-month period (40 days in total);
- requests must be made to your Class Manager at least 7 days in advance, except in a medical emergency, where we will act reasonably.
During an approved pause, no Sessions are deducted. Course validity under Section 11 is extended by the length of the approved pause. Absence that has not been approved as a pause is treated as no-show under Section 5 and continues to consume Sessions and validity.
Mentor allocation and changes
We allocate Mentors on the basis of subject expertise, curriculum stage and schedule requirements. We reserve the right to make temporary or permanent Mentor changes where this is necessary to maintain the quality and continuity of teaching, to reflect curriculum progression, or because of Mentor availability.
You may also request a Mentor change. Requests are made to your Class Manager and are actioned after the Class Manager has observed the Sessions concerned and assessed the position. We will always act reasonably, and a change is subject to the availability of a suitable alternative Mentor.
A change of Mentor is not, by itself, grounds for a refund.
Course validity
Each Programme carries a validity period, calculated on the basis of two Sessions per week plus reasonable allowance for holidays and rescheduling. Validity runs from the date of your first scheduled Session.
| Package | Validity from first session | Approx. sessions per week |
|---|---|---|
| 50 sessions | 7 months | 2 |
| 100 sessions | 14 months | 2 |
| 150 sessions | 21 months | 2 |
| 200 sessions | 28 months | 2 |
| 250 sessions | 35 months | 2 |
Sessions not consumed by the end of the validity period expire. Expired Sessions are treated as delivered, are not refundable and are not carried forward, where the delay is attributable to you.
Validity is extended by: (a) the duration of any approved pause under Section 9; (b) any period during which we were unable to deliver Sessions for reasons attributable to us; and (c) any extension we grant in writing at our discretion.
Before validity expires: we will notify you when your Programme approaches the end of its validity period so that you have the opportunity to complete your remaining Sessions or request an extension. Extension requests should be made to your Class Manager in writing.
Fees and payment
Fees are those quoted to you in writing at the time of enrolment and confirmed on your invoice. All fees are exclusive of any taxes, levies or bank charges that may apply, which are payable by you.
We accept: bank transfer, debit and credit cards, UPI, online transfers, approved third-party payment applications, and payment links issued by us. We do not accept cash.
Payments are processed by third-party payment gateways, whose own terms apply to the transaction. We do not store your full card details. We are not liable for the acts, omissions, errors, outages or security failures of any payment gateway, nor for any unauthorised use of your payment instrument that is not caused by us.
Fees quoted for one Programme are specific to that Programme and to the date of purchase. If you later enrol in a further or different Programme, the fee will be our prevailing rate at that time, which may be higher or lower than the rate you previously paid.
Instalment plans
At the time of enrolment you may choose to pay in full, or to pay in three instalments where we offer that option for your Programme.
| Instalment | Share of total | Example ($1,000 prog.) | When due |
|---|---|---|---|
| First | 50% | $500 | At admission, before classes begin |
| Second | 30% | $300 | Before 90% of Sessions covered by 1st instalment are completed |
| Third | 20% | $200 | Before 90% of Sessions covered by 2nd instalment are completed |
Worked example: On a 100-Session Programme priced at $1,000: you pay $500 at admission, which covers Sessions 1–50. Your second instalment of $300 falls due once Session 45 is completed (90% of 50), and covers Sessions 51–80. Your third instalment of $200 falls due once Session 72 is completed (90% of the 30 Sessions covered by the second instalment), and covers Sessions 81–100.
Instalment pricing differs from upfront pricing. The total payable under an instalment plan may be higher than the discounted upfront price. The applicable price is disclosed to you at the time of admission.
Your price is locked for the full duration of the Programme you have enrolled in. We will not increase the agreed instalment amounts during that Programme.
If an instalment is not paid by its due date, Sessions are suspended until payment is received. Course validity under Section 11 continues to run during a suspension for non-payment.
You may choose not to continue to the next instalment. In that case you may complete all Sessions already paid for, after which the Programme ends and your subscription is cancelled. You are not charged further.
Refunds
We want you to be satisfied. Before any refund is considered, please raise your concern with your Class Manager so that we have the opportunity to resolve it — including by changing your Mentor, adjusting the curriculum, or altering your schedule.
14.1 Eligibility
A refund request will be considered only where all of the following are met:
- the Student has completed a minimum of 30 Sessions;
- the Student has maintained at least 90% attendance across the Sessions consumed, excluding Sessions cancelled by us; and
- the request is made in writing to the address in Section 30.
14.2 How a refund is calculated
Approved refunds are calculated on a pro-rata basis for unused Sessions only. Sessions consumed, no-shows, late cancellations and lapsed reschedules are treated as delivered and are not refundable. Any discount, referral reward, sibling discount or scholarship applied to your Programme is recalculated or withdrawn, and any promotional benefit already paid out to you is deducted from the refund. Payment gateway charges and taxes already remitted are non-refundable.
14.3 Circumstances that do not qualify
The following, on their own, are not grounds for refund: change of financial circumstances, relocation, scheduling conflicts, other personal commitments, loss of interest, a change of Mentor made in accordance with Section 10, or the Student's failure to attend or complete homework.
14.4 Instalment plans
Refunds are not available on instalment plans. Your protection under an instalment plan is that you may opt out: complete the Sessions covered by the instalment you have already paid, then decline the next instalment. The Programme ends at that point and nothing further is charged.
14.5 Processing
Approved refunds are processed within 21 business days of approval, to the original payment method where possible. This Section supersedes any refund terms communicated to you previously.
Intellectual property
All curriculum, lesson plans, worksheets, assessments, recordings, methodology, software, Platform content, branding, and all other material we make available — in any format, whether video, audio, written or graphic — is and remains our exclusive property or that of our licensors.
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use that material solely for the Student's own learning during the Programme. You may not reproduce, publish, distribute, sell, sub-licence, transmit or create derivative works from it, nor use it for any commercial purpose, without our prior written consent.
You may not copy, decompile, reverse engineer, or attempt to derive the source code of any part of the Platform.
Recording of sessions
We may record Sessions for quality assurance, mentor training, safeguarding, dispute resolution and service improvement. By enrolling, you consent to such recording. Recordings are handled in accordance with Section 19 and are retained only for as long as is necessary for those purposes.
You may not record, screenshot, download, stream or otherwise capture any Session — by any means, including a second device — without our prior written approval. Unauthorised recording is a breach of these Terms and an infringement of our intellectual property rights.
If you would like a copy of a recording of your own child's Session, ask your Class Manager; we will provide it where we reasonably can.
Confidentiality of our materials
Our curriculum, course content, portal information, login credentials, internal documents, pricing, mentor details and all other non-public information relating to our business are confidential. You must not share, disclose, publish or transmit any of it to any person who is not party to your enrolment.
Breach of this Section entitles us to seek injunctive relief and specific performance, in addition to damages and any other remedy available to us.
We keep your information confidential in accordance with Section 19.
Acceptable use
You agree that you will not, and will ensure that the Student does not:
- use the Platform for any unlawful purpose, or in breach of any law applicable to you;
- provide false, inaccurate or incomplete information;
- hack, probe, scan or test the vulnerability of the Platform, or gain or attempt to gain unauthorised access to any server, account or data;
- tamper with, alter or interfere with any code, data or content on the Platform;
- use any automated tool, script, bot or third-party software to interfere with the Platform or to obtain an unfair advantage in any assessment;
- impersonate any person, or misrepresent your relationship to the Student;
- use the Platform to advertise, solicit or conduct any commercial activity;
- upload or transmit any material that is defamatory, obscene, abusive, threatening, harassing, discriminatory, plagiarised, misleading, or that infringes any third party's rights;
- harm, or attempt to harm, any other user, Mentor or member of our team;
- share account credentials, or allow any person other than the enrolled Student to attend Sessions.
We may monitor use of the Platform to detect unauthorised programs or activity that interfere with the integrity of Sessions or assessments.
Privacy and your data
We collect and process personal data in order to deliver the Programme. This includes: the name, age, grade, school, contact details and address of the Parent and Student; academic records, assessment results and progress notes; session recordings; payment and billing information; and technical data such as device, log and usage information.
19.1 Why we use it
- to register, onboard and teach the Student, and to report on progress;
- to schedule Sessions, allocate Mentors and provide support;
- to process payments and maintain financial records;
- to improve our curriculum, train our Mentors and assure quality;
- to communicate with you about your Programme; and
- to comply with our legal and regulatory obligations.
19.2 Who we share it with
We share personal data only with: the Mentor and Class Manager assigned to the Student; our service providers (hosting, video conferencing, payment gateways, communication tools), who are permitted to use it only to provide services to us; and any authority to whom we are required by law to disclose it. We do not sell your personal data, and we do not share it with third parties for their own marketing.
19.3 Children's data
Where the Student is under 18, all personal data relating to the Student is provided and controlled by the Parent. We collect only what we need in order to teach. A Parent may at any time request access to, correction of, or deletion of their child's data, subject to records we are required to retain.
19.4 Security and retention
We apply reasonable technical and organisational measures to protect personal data. No system is completely secure, and we cannot guarantee absolute security. We retain personal data for as long as the Programme is active and thereafter only as long as is necessary for legal, accounting, dispute or safeguarding purposes.
19.5 Your rights
You may request access to, correction of, or deletion of your personal data, object to its processing, or withdraw a consent you have given, by writing to us at the address in Section 30. We will respond within a reasonable period. Withdrawing consent that is necessary for us to deliver the Programme may mean we can no longer provide it.
Testimonials and student work
We would like to celebrate what our students achieve. We may ask to feature a Student's name, photograph, results, project work, review or testimonial on our website, portal, social media and marketing material, and to show it to prospective customers.
We will only do this with your separate, written, opt-in consent. Consent is specific to the material concerned, is entirely voluntary, is not a condition of enrolment, and may be withdrawn at any time by writing to us — after which we will stop using the material in any new publication and remove it from our own channels within a reasonable period.
Where you submit content to us — reviews, photographs, videos, project work or comments — you grant us a non-exclusive, royalty-free licence to host and display it on the Platform for the purpose of delivering and improving the Programme. Ownership of your content remains yours. We may remove any user content that breaches Section 18, without notice.
Third-party services
We use third-party software and services to deliver the Programme, including video conferencing, hosting, payment gateways and communication tools. Your use of those services is additionally governed by the relevant provider's own terms and privacy policy.
We are not responsible for errors, defects, outages, interruptions or security failures in any third-party service, nor for any dispute between you and a third-party provider. Where we are able to assist in resolving such a matter, we will do so.
Links to third-party websites are provided for convenience only and do not imply our endorsement.
Communications from us
By registering, you consent to receive service communications from us by email, telephone, WhatsApp and SMS, relating to scheduling, homework, progress, payments and account matters. These are necessary to deliver the Programme and cannot be opted out of while your Programme is active.
Marketing communications are sent only where you have agreed to receive them. You may opt out at any time by replying STOP, using the unsubscribe link, or contacting your Class Manager. Standard carrier charges may apply to messages you receive.
Disclaimers and limitation of liability
We will deliver the Programme with reasonable care and skill, and we select and train our Mentors carefully.
We do not guarantee any particular academic result, examination grade, rank, admission or outcome. Educational outcomes depend on the Student's own effort, attendance, aptitude and circumstances. Our Programme supplements, and does not replace, the Student's school education.
The Platform is provided on an "as available" basis. We do not warrant that it will be uninterrupted, timely, error-free or compatible with every device. Services are supported on devices and software meeting our published minimum requirements.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of opportunity, examination results, school placement, data or goodwill. Our total aggregate liability arising out of or in connection with these Terms is limited to the total fees you have actually paid to us for the Programme giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
Indemnity
You agree to indemnify and hold harmless 2ndRank, Mittal Education and their proprietors, employees, Mentors and contractors against any claim, loss, damage, cost or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Platform, your breach of any applicable law, or your infringement of any third party's rights.
Suspension and termination
We may suspend or terminate your access, in whole or in part, where:
- you breach these Terms, in particular Sections 7, 15, 16, 17 or 18;
- a payment or instalment is overdue;
- there is abusive, threatening or harassing conduct towards our team or Mentors; or
- we are required to do so by law.
Save where the breach is serious or repeated, we will give you written notice and a reasonable opportunity to put the matter right before terminating.
Termination for your breach does not entitle you to a refund of Sessions consumed, and Section 14 governs any refund of unused Sessions. You may terminate at any time by writing to us and ceasing to use the Platform; Section 14 governs the financial consequences.
Sections 15, 16, 17, 19, 23, 24 and 29 survive termination.
Events outside our control
We are not liable for any failure or delay in performing our obligations caused by an event beyond our reasonable control, including internet or power outages, failure of telecommunications networks, natural disaster, epidemic, fire, flood, civil disturbance, strike, war, or act of government. Where such an event prevents Sessions from being delivered, those Sessions are added back to your schedule and your course validity is extended accordingly.
Changes to these Terms
We may update these Terms from time to time to reflect changes in our services, operations or the law. The current version is always published on our website, with the effective date shown at the top.
Where a change materially affects your existing rights — for example a change to refunds, pricing, course validity or cancellation — we will give you at least 30 days' written notice, and the change will not apply retrospectively to a Programme you have already paid for. Minor and administrative changes take effect when published.
General
- Entire agreement: These Terms, together with our Referral and Scholarship Policy and your invoice, constitute the entire agreement between us and supersede any prior discussion, representation or arrangement.
- Severability: If any provision is held invalid or unenforceable, it is severed and the remainder continues in full force.
- Waiver: A failure or delay by us in enforcing any right is not a waiver of that right, and does not prevent us from enforcing it later.
- Assignment: You may not assign or transfer your rights under these Terms. We may assign them to a successor to our business on written notice to you.
- No agency: Nothing in these Terms creates a partnership, agency, employment or fiduciary relationship between us.
- Language: These Terms are issued in English, which governs in the event of any translation.
Governing law and dispute resolution
These Terms are governed by the laws of India.
Step 1 — talk to us: If you have a complaint, write to us at the address in Section 30. We will acknowledge within 5 business days and aim to resolve the matter within 30 days. Most issues are settled at this stage.
Step 2 — arbitration: Any dispute not resolved under Step 1 shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be [City], India, the language shall be English, and each party shall bear its own costs unless the arbitrator directs otherwise. The arbitrator's award is final and binding. The arbitrator shall be appointed by mutual agreement between the parties; failing agreement within 30 days, by the competent court.
Subject to the above, the courts at [City], India have exclusive jurisdiction.
If you are a consumer outside India: nothing in this Section removes any right you have under the mandatory consumer protection laws of the country in which you reside, including any right to bring proceedings in your local courts.
